Abstract

This opinion provides a critical discussion of the judgment in 'Thaler v Comptroller-General', in which the Supreme Court held that patent applications lacking a traditional human inventor must be denied. The opinion discusses the background of the case and next steps for patent applications for AI-generated inventions internationally, and it explores patentability implications of the judgment for using AI in research and development.
